Most people in the US don't know it but: There cannot be a prosecution for a "victimless crime". Well, why is that? Because it would be a conflict of interest. Who would do the prosecution? The state! Who is the state? You are the state. Would you condemn yourself? Would you testify against yourself?

The state cannot have jurisdiction. If there is such a thing as a "victimless crime", and there isn't under common law, the supreme court would have jurisdiction. It is the only branch of government that could lawfully oversee the proceedings. Then, if the punishment could be incarceration, the prosecutors would have to convene a grand jury to indite you. Is this likely? No. The "law" of the land is not followed.

A grand jury wouldn't put up with all the mess that is going on. They would only indite if there is evidence ... not fabrication or circumstances. They would follow the law.
